Do I have to file our income taxes together? |
My husband and I recently filed bankruptcy in 2006 together. Since income tax season is coming up, I am wondering if I have to file our income taxes as married, or can i file married but seperate. We have seperated but still remain married as of today. Any suggestions? No you do not have to file jointly, but you will not be available to take the refundable credits that will help you like the E.I.C. if you have children this credit helps you get a bigger refund. Unless it is court ordered for yall's income tax refund to go to a creditor. Ya ll filing jointly with having a bankruptcy shouldn't effect your tax return. Source(s): I do taxes for a living. Don't take my word for this, but I believe you should be able to do this seperately. I don't see why not, just like if you have children that doesn't mean you have to claim dependants. Anyway, bankruptcy shouldnt have anything to do with whether or not you can file seperate. If you and your husband are on speaking terms and each earned approximately the same amount and had deducted from your checks similar amounts, then try to file as married jointly. Married seperately has lots of disadvantages. But it really depends on your income levels and how much each of you can agree on any refund or liability. My suggestion is see a lawyer!... Probably no one here is qualified to answer it. It might cost $25 or so if you go thru lawyers reference or legal aid ..........It will certainly be worth it. Better safe than sorry! Good Luck! opinion Check with the IRS website www.irs.gov and they'll have the guidelines of how you can file. If you're still legally married you can file a separate return, but I don't know how that figures in with the bankruptcy. They should have an 800 number you can call to talk to someone and ask. Even if you live together you can file a separate return. |
