Do you know if i can file income taxes on kids not mine but living in the house with me an girlfriend her kids |
ok we live together she has 2 kids i was trying to find out if i can file them on my taxes since she does not have any taxes if you know please help me. Starting in 2005, you can't claim your girlfriend's kids as dependents, nor can you claim "head of household" status on your tax return, even though you are the sole breadwinner. What TMV said was correct, but only through the 2004 filing year. Up until then, a man could claim his girlfriend and her child both as his dependents and file his return as a head of household, resulting in lower taxes. But since 2005, you may not use the children to claim head-of-household status because you and the children are not blood related. Now the primary test is the relationship test, and you would fail that because you and the child are not related. And since the mother is not employed, and therefore does not file income tax returns, no one can claim these children as dependents -- not even the person who provides 100 percent of their financial support. It's a sorry situation, but there it is. Maybe. Someone can claim them. You need to find out if the Father is claiming them since the mother obviously isnt. If the biological father does not have a court order stating that he can claim the childeren as dependent then you should be able to claim the children and the mother because you are providing for them (single and three dependents) Been there done that 2 years ago: Yes Now: No. The rules changed on this a couple of years ago. As the children qualify as her dependents, you can not claim them. No you can not claim them, unless you are married to there mother. I'm in same situation and i called the IRS they informed me that my boyfriend could not claim my daughter due to the fact that I could claim her if i were working.
