What do I do? My son filed income taxes using myself and younger son as deductions without my permission? |
I need this refund as I am homeless and my truck is tore up. I emailed him with no response. Tomorrow if i do not hear from him, I will call the real IRS. even if you do hear from him, you'd be ahead to call the IRS and explain. That's exactly what you should do. If you can't get a hold of him so something! I mean your within your rights to sue him over any lost money because he did not have your permission. Just talk to the IRS and they SHOULD take care of it go ahead and file it take typically 2 years for them to catch up to accounting error ( that is someone will be paid twice or an deduction will be claimed on 2 different returns), if he cannot prove he can legally claim you ( and there is a test that under the IRS guideline he must meet to claim the deductions ), but if he does meet the guildlines and he does support you , then he has the right to claim the deductions. once they catch the error they will call both of you into a service center and straighten the matter out, who ever is found in error will have to pay back the tax refunded and possibly a tax penalty plus interest. File your return with the truth, but keep your documentation, some proof to back up your story. Don't wait to hear from the IRS. The IRS will challenge your return first before doing anything bad to you, and when you show them your documentation, they may investigate your son. But that's his problem, not yours.
