Your question is missing some details, but if you are asking what to do if you are entitled to claim your child as a dependent and someone else (ie. ex-spouse, grandparent, etc.) is taking the same child as dependent, then this is my answer:

You are required to file YOUR tax return accurately. If someone else doesn't file accurately that is not your problem.

Dependents are identified by SSN on the 1040, so the IRS matching computers WILL find that a single dependent is being claimed twice. So you will need to be prepared to defend that you are entitled to the dependent in question. The best way to defend depends on the circumstances, but for example if divorce is the issue then there should be a divorce decree or other document that spells out who is entitled to claim a child for tax purposes.

Do they have the right to claim your children? If you have the right, and you claim them also, the IRS will come and ask questions. The one that shouldn't be claiming them should have the exemption disallowed.
File the taxes yourself legally claiming the children.

The IRS will then contact you both and decide who has the legal right to claim them.
If you can prove to the IRS that you provided more than half the care, and you are the custodial parent, I would mail your taxes in with your children's soc. numbers on it and file. They will send you and the other party a letter. Whoever can prove what I just stated will get the credits for the child/children and the other party if they have already been issued a refund for the year/years that they have claimed the child/children will have to pay back the IRS and prob. with interest as well. If someone has claimed (I'm presuming your child/children), not only for 2006 but any other years you will need to amend those tax years as well and claim the kids in those years. The IRS will look at school records, doctors bills, etc to see where the kids are at and who is responsible for them as well as their bills.
