YES!! You can claim him even if he was born on December 31 at 11:59:59pm!
Yes. Even if your child is born at 12:59 and 59 seconds on New Years Eve you can claim them.

Make sure to adjust your deductions at work now, so they won't be taking out so much this year; Now you have an exemption!
I am not 100% sure, but I do not think that you can. The reason being is that I believe he must be living with you at least 6 months. You can always call the IRS or even one those places that files taxes for you.
