Can you include Federal Income Tax due in bankruptcy? What about student loan debt? No on both. Those are the two items that you are stuck with no matter what! Not sure about the Tax one, but I know you can't use student loans anymore. Usually no to both. There are some very specific circumstances if you can prove hardship that you may be able to include them in a bankruptcy, but generally, you cannot. you cannot write off student loan debt in bankruptcy. federal income tax can be eliminated in certain circumstances which your attorney will help you with. but if its recent year income tax due, then probably not. NO YOU CAN'T CLAIM STUDENT LOANS IN BANKRUPTCY. MY SISTER TRIED JUST LAST WEEK AND THEY SAID NO GO. I HOPE ALL WORKS OUT FOR YOU. you cannot include any income tax into a bankruptcy If you owe IRS money believe me they will collect. I really doubt you can declare Bankruptcy with this. As far as student loans you can get them deferred or get a forbearance but you have to pay them back one way or another. Bankruptcy will not take care of the problem as far I know or I would have already done so. |
