Auto insurance agents in california please. Re: ticket and trial by declaration lost case?

Hello, I received a ticket for speeding, i fought it via trial by declaration, lost the case. I went to the court today to see if i could still take traffic school. The clerk told me that i have to schedule a court date two months from today to ask the judge in person. from now until two months does my insurance go up since i lost the case? what if i AM allowed to take traffic school? will this just take the point of my record or will it also prevent my insurance from going up? Please give me all the info you might have. Thanks! Also, what if my insurance starts going up starting next month, if i am allowed traffic school, will this make my insurance go back down?

first of all, no insurance company can increase your rate f/ a violation until the renewal of your policy, when they run your mvr. and actually, they typically run it a couple months earlier so if the violation was in the time between your renewal and when they ran the report, your clear f/ another 6-12 months.
however, points on your license and points on your insurance are 2 different things. even if u are able to go to traffic school to have the points removed from your license, you will still be charged for a violation on your insurance. traffic school does not make the violation go away.

From what I understand, if you plead innocent (ie trial by declaration) and lose, you can't take traffic school for that ticket.
you would have to contact YOUR insurance agent to find out what will happen in YOUR particular case. Both of my parents are insurance agents at an independent insurance agency, in Novato, CA (near San Francisco).

I am actually researching a very similar question: if you lose your trial by declaration, can you take traffic school still. i am in Southern CA and from my research so far, it does not appear that you can, although the sure way to find out would be to call the traffic court on your ticket. You are allowed however to request for a trial de novo. If you find out you cannot do traffic school, you should request a trial de novo ( there probably is some deadline, so find that out), for you have nothing to lose if you can't do traffic school. My understanding is that the points don't go to the DMV until the deadlines have passed, ie, you missed deadline to go to traffic school, pay your fines, day in court...
