Would i have to go to court if i dnt pay an insurance claim from another person? |
i recently hit a car very softly behind the boot.. there were minor scratches, not even that,, it was very small basically. The driver of the other car was very nice and said to me he wasnt going to claim anything cos it was very small. i have now received a letter stating that he has claimed and that the final ammount will b mailed to me. Im hoping the cost isnt alot but if it is, i cant afford it right now so if i dont pay it, do i go to court and can i get out of it by doing community service Well...... If the driver had his insurance company take care of the damages he can NOT take you to court. He surrenders his right to collect from you once he collects from his carrier. When the carrier subrogates, if you do not have the money to pay, they can setup a payment plan for you. You will have to sign a Promissory Note and make your payments on time. You do not want to default. The carrier CAN take you to court. They can have a lien established against anything you own - if you own anything. That part can get kinda ugly so...just stay on top of your payments if that is the route you go. BTW - hopefully you have insurance? Your carrier would take care of paying the other insurance company back. If you DON'T have insurance? The other guys insurance company can have your license suspended (in some states) and you would not be able to get it back until you got insurance and in some cases paid the damages you were responsible for. Since its claims court the judge will order you to pay and probably won't offer community service, they may garnish your wages. Try speaking with the guy and see if he can drop the claim and see if you can work out a private payment plan, make sure you sign papers. Yes, the other driver can take you to court if you do not pay. And no, community service would not be an option if you cannot pay. The court will file a judgment against you, and you will be required to pay. Keep in mind, you can require that the driver get more than one estimate for fixing the damage, and then you can pay whichever amount is less. Do you have car insurance? If you do, file a claim with them. The damage should be covered under your policy. Although, here's some food for thought - anytime you're in an accident, even if it's just a little fender-bender, always call the police and make an accident report. Whether you are at fault or the other driver is, having an accident report protects everyone. How is doing community service going to compensate the other driver for his loss? They want restitution in the form of money. |
