In the state of California is there a formula insurance companies use to calculate personal injury settlements |
I was rear ended with some injury. I don鈥檛 know what to expect regarding a settlement or if I should contact an attorney. I am not a litigious person just want what is right. Any advice would be appreciated. Thanks in advance! No, there is no formula in any state. Don't listen to anyone who tells you it is 3 times anything. Just be reasonable with your request. Since I've told you it's not normally a multiplier times your special damages, that should help you know that if you ask for 3 times or more, you're outrageously high. Source(s): * What are your cost and lost such as time off from work ect. That is what you should ask for an insurance settlement is not a source of profit or money it is to cover loss and make thing right. It seems like the one formula that is used if your are an illegally Mexican you triple the claim amount. Also if you are not insured you get nothing. Check with the laws of your state regarding what the insurance must pay you if you are not at fault. A reputable attorney can also tell you. Remember, the insurance company for the other driver is going to have a screw you attitude and try to settle your claim as cheap as they can so they can wash their hands of you. Personal experience, I was in a auto accident in 1999 that was not my fault. |
