If you were rear ended but driving without insurance, are you entitled to a settlement?



If the person that hit you was at fault and had full coverage, will your car and medical bills get paid even though you were driving illegally(mandatory insurance law in illinois)

you are entitled to have your vehicle fixed and your med bills paid, but not pain and suffering...atleast thats the law in claifornia
IMO you are entitled to JAIL TIME!!! don't drive without insurance...

You would need to know more about state law in regard to allocating fault. You should get legal advice, you may wait until the insurance company advises you what they are going to do.
It depends on the state law. Some states have "no fault" insurance where your own company always pays your medical bills. If you are not in a "no fault" state, the driver responsible for the accident is responsible for the damage & medical.
I'm not sure about IL, however in CA, if a person does not have valid liability coverage, however are injured in a car accident and are not at fault - they are only entitled to be compensated for their reasonable and necessary medical expenses, not for pain and suffering (Prop 213). I'm sure many other states have similar statutes/propositions.
