Should my ex-husband be intitled to claim our child as a dependent if I pay their medical insurance? person who has custody gets to claim unless custodial parent signs a document allowing non custodial to do that. there is a five point checklist to determine whether you can claim a kid as a dependent and medical 'insurance provider' is not on the list Seems to me the person the child lives with should be the one to claim them. My parents negotiated every year when I was a kid about who was going to claim me. Mom usually won until Dad had to fork over $2000 for braces. He can only claim them as a dependant if they live with him more than 6 months out of a year! If he has physical custody of them...of course. Depends.. usually in the divorce papers it will state who has the right to claim the child or children in the divorce decree, for example my x husband claims one of our kids, and i get to claim the other.. And he's over 10,000 in the hole.. has only seen them 3 times in 7 years..and up untill a year ago had never helped me with child care or medical expenses.. BUT as wrong as it is for him to claim our son , theres nothing i can do about it with out taking him to court to have it changed.. If i tried to claim him and he claims him as well, all he has to do is show the IRS that he has legal papers to have the right to claim him, and u can get into trouble with the IRS ..so its not worth it.. so if u think theres just cause to have it reversed then do it the legal way and let a judge decide.. before just trying to "pay him back" for being a crappy father.. the only way he can claim your child as a dependent is if he has primary physical custody.or,if he doesnt have custody, if you made a stipulation in the custody agreement that he can claim the child. |
