In NCarolina can a spouse who does not have legal separation papers drawn, cancel insurance, medical or car? |
a person I know recently learned that the sepatation papers she has are not legal do to a technical problem. The spouse has stopped the medical insurance and is planning on doing the same to the car. They canceled it while a child was still in private home school. Can a lawyer help with the anwswer on this? This person would like a staight answer. They were also put out of a rent house and now child has kidney infection and no medical insurance. The child was taken by the spouse then dumped out on the street once their spouse didn't see any usefullness in the child. This was all done to hurt the other spouse and the child. But it makes no sense to anyone I know who knows the person who is being hurt or the child. I have read the supposed "separation papers" and it makes little to no sense to me at all. Just rantings and ravings, it isn't even done by a lawyer. And there is no court date or anything.They are pennieless now, I wish I knew a pro-bono lawyer who would help them out. Look for your local legal aid office. These services are free North Carolina sucks a big dick when it comes to divorce laws. I know this from my present experience. Move to another state just long enough to be a citizen there and then file for divorce in that state. Not sure if it is different from state to state. But in general car insurance can be cancelled, however health insurance cannot without a divorce decree. TOOO LONG... This is sad..BUT A person can do what they chose..He may not be able to afford it..AND if he can't..There's no law. Regardless of how much of piece of **** he is.. There's the possibility of abandonment..Perhaps she may be able to get child support. You/she needs to see a lawyer for any legal advice. The reality of the situation she needs to get a job! If they are separated, she really can't expect him to pay everything. She needs to get her independence..Why give a man this much control..Especially if he's able to dictate whether or not she rides, or have insurance. Try temporary medical assistance from the state. She just needs to prepare herself, to support herself and child.. The guy is probably pissed off and doing whatever he can to make her suffer. She just needs to do what she need to do to take care of herself and the children. Period end of story. find a lawyer on a free consultation, and have them look it over and advise. i would ******* sue, thats horrible but ive heard worse. revenge would be best in my case, but try a lawyer or hit the courts with it and make a big stink about it. worse comes to worse hit the press. IM GONNA ASSUME IT WAS A MAN BECAUSE MEN DO THIS. TRUST ME. IT'S AN ISSUE OF CONTROL. That is abandonment and they need a lawyer quick! If not the one living from place to place, the other is gonna say they can't care for the child and try to take it. write every event down dates time etc to use for court. Actually the person paying can, indeed, cancel these things. It is usually a court ordered continuation of these things that are included in the divorce decree. Insurance companies have only certain times in which one can modify one's health insurance: open enrollment (usully one timeframe per year) marriage, birth, death, divorce or separation (in Michigan, for example, separation is physical requirement and not necessarily legal) |
