Injury settlement. Will insurance still pay for any furhter medical problems as a result of the injury?



In anticipation of an injury settlement offer regarding a slip and fall injury within a grocery store, I am interested in the ramifications of accepting a settlement. The insurance company will be reimbursed upon settlement for expeses they have paid to date. My concern is will they pay any further claims related to this injury once we have accepted a settlement from the grocers insurance company. The injured party has already had a procedure done on her lower back which has given her significant relief. However, it still flares up on occasion and we feel it is not a question of if she will need further medical intervention, but when. Any advice from those that are in the know about such things will be greatly appreciated. Thank you!

You MUST stipulate in the settlement that the possibility of further medical procedures exist and that if they occur as a direct result of this injury the company would be on the hook for the cost. This will reduce your monetary settlement and would be in lieu of any money paid to you for future medical treatments. The only money you would receive is for pain and suffering or loss of work. But don't let them buy you off with 100k to cover future medical expenses, which is what they try to do or you will pay all future costs and they will be done. Another thing to consider is why settle at all. It sounds like you have a good case a settlement might only be in the interest of the company and your lawyer not you. If you settle, then you have settled. It's done, they've paid and you're on your own. Best way is to seek a qualified attorney to help you.
There are two parts to a settlement; the monetary damages (medical expenses, lost wages, etc) and the pain and suffering portion. You can settle one part without settling both, or you can settle both. If the settlement is for both portions, then no further medical payments would be forthcoming. If you want to leave open the possibility of future medical payments, then you can't settle that portion of it now.
