Is it legal for a mortgage lender to deny a loan to an American Citizen who was born an African....?



based solely on the fact that she can't provide any other documentation to prove her citizenship other than SS card & driver's license?

As someone who has been in the business over 15 years this is the FIRST time I have seen a mortgage lender ask for this information to give a loan. All other loans have been closed with SS card & driver's license only.

Since my client has been a citizen for more than 20+ years she has no idea where her "certificate" of citizenship is packed and it would take weeks to get a new one. In the mean time she will lose the house she is trying to buy. She has never registered to vote so no voter card & she has never obtained a passport.

Do you think she has a case against this mortgage company for discrimination?

If you applied for loan, would they ask you to prove your citizenship? I would ask the lender that question directly. If they are treating your client any differently that they would treat you, that is a prima facie instance of discrimination.
She should contact an attorney immediately and ask him to contact the lender. Don't hesitate because if you do the lady could lose the house. The anything else she might do about it is meaningless.
Well...possibly. I'm not an expert in mortgage law. While the question of RACE is illegal to discriminate against, there might be some statute or regulation for the particular loan package she is applying for that requires definitive proof of citizenship (like a government subsidized HUD loan, for example)? If the loan requires proof for some reason, then it isn't discrimination.

In that case, a SSN and DL don't prove citizenship (my wife is a resident only, and has both).

When people apply for residency and citizenship, they are well advised to obtain every type of ID they can (20 years a citizen and hasn't voted or gotten a passport? Why did she bother exactly?). Keep this ID in a safe place where you have easy access to it at short notice.
no, the mortage company has a right to its underwriting rules, they are free to go to another company if they don't like these rules.

And a company can require you to prove legal status in the US, to give a loan,discrimination has to be because of a protgected right, it is perfectly legal to discriminate against people if the reason is a legal reason
