No, but you'll mess up your credit for a long time.

They can make threats, but really, they can't MAKE anyone pay back a loan. They can't even garnish your wages. They can summon you to court. But even if they win the judgement, they can't force you to pay.
No, we do not have debtors prisons.

That said, they CAN take you to court. They CAN send you to collections. They CAN get a judgement. They CAN garnish your wages or force you to sell assets.

But, they can't send you to jail.

No, there are no debtor's prisons in the US.

In TX they cannot garnish your wages or slap a lien on your homestead. In fact, under TX law the interest rate will drop to 6% as soon as it goes into collections. They might get a judgment but if you don't have any other assets it's a paper victory.

Hi i was in the same boat a couple of years ago. im wondering if you are asking this question because a debt collector told you that you can be arrested?
My payday loan went into a collection agency, the collector called me and said they were from an attorney's office and i needed to pay the debt immediately. I wrote a post dated check for the payday advance place to cash once my payment was due. Of course when they tried to cash it later, the funds werent in my account and they were never able to collect. The collections rep told me that because i wrote a check that couldnt be cashed, it was considered a hot check and i could be prosecuted. She told me that if i didnt pay immediately, a warrant for my arrest would be issued and they would come to my place of employment and pick me up.
Needless to say, i was freaked out!! i was only 20 yrs old, i didnt have the money and i thought i was going to jail. I called an attorney in the yellow pages and asked him about this. he was very nice to give me free advice, he said they were lying and trying to scare me. The D.A. does not prosecute on post dated checks and certainly not on payday loans.
He was right, they straight up lied to scared me into paying. Nothing happened to me, they were just a regular collection agency trying to get paid.
Im not proud of the whole situation, but i hope youre assured now that you wont go to jail. By the way, i am also in Texas.
