Can insurance comp. that is liable cut off nonfault party's rental car before property check received? Yes, but it's not really that simple an answer and you'll likely need to check with the company you're dealing with if you're the adverse party and not their insured. If your vehicle was a total loss, most insurance companies will only pay your rental until they day you agree on a settlement figure, plus a few days for weekends and whatnot - not until the check is received and not until you find a new car. If your vehicle was repairable, you should be able to sign a "Direction to Pay" at your body shop and pick up your car and let the shop get the check. Now, if the estimate includes 10 days of body work and your shop has taken 20-30 days due to no fault of the insurance company, most of them will cut off your rental and tell you to seek additional days from the shop itself if the shop is a delay problem. If you're in the middle of arguing over car value, all companies terminate rental at what point they would have been reasonably able to resolve the claim if you'd have agreed (usually anywhere from 5-15 days for a total loss.) You can continue to rent at your own expense and attempt to negotiate it later, but it can be very tough to do. They might also terminate rental if there's a policy limits problem, they're awaiting something from you that's taking too long (a title, a release, etc) or any number of reasons. I'm not making a "fair" or "not fair" judgement, just trying to explain what goes on. Call in to your adjuster or their manager and get a specific explaination of why your rental is being cut off. If you don't understand or they're speaking insurance-ese, make them break it down. If you have valid collision and rental coverage on your own policy and you still aren't happy, I recommend going back to your own company and letting them fight it out on your behalf.
