Can a buyer of tax deed properties aquire title insurance in Kern County?



Is it possible after purchaseing property at a tax sale in Kern County,Ca.,that a buyer can sell a property and get title insurance.

Yes, you can get title insurance on any property. Getting title insurance showing a clean title is something else.

If the tax lien was the only lien on the property when you bought it, then you have clean title. If all other liens were paid off as a result of the purchase or if the lender signed off, then you have no problem.

If there are other liens on the property or other owners of record, the title insurance will be issued "subject to" those people and lien holders. Therefore, you CAN get the title insurance, but it would be worthless to a new buyer and their lender. The sale will fall through.

You have 2 options:

Go to a good title company like First American Title Company and ask them to run a chain of title for you to make sure you have good unblemished title. Offer to pay for it.

Go to the Kern County Clerk and Recorder's Office and do it your self. Before you do that, make sure you know what the heck you are doing.

The title company will do a more thorough job for you and the peace of mind is worth it. If your plan is to sell the property and you promise the title order to them, they will cut you a break.

I think you should call them. I also think you are probably okay with the title, but there could be something lurking in the back ground. The information on your paperwork should clearly outline any outstanding lienholders, if any, on the property.

P.S. Visit the property. There are exclusions in title insurance for "parties in possession" and people who are adversely using the property as ingress and egress for accessing their own parcels of land, whether they have the right or not. Kern County is vast. Get a plat map from the City or County and know your lot lines and fencing issues if we are talking about acreages here. The title companies also don't insure anything a survey would have revealed.
