In the state of NC - Homeowners Insurance Question? |
If a neighbors tree falls on our house, who is responsible for repairs - us, or the neighbor? The cause of the tree falling would be from high winds. Does the insurance company matter? We have USAA. Except in ONE instance, it is going to be you. Your homeowners policy will cover the damage the neighbor's tree did when it fell on your house. The ONLY time they can be held responsible, is if the tree was rotted, AND the neighbor knew it, and didn't do anything. And it's pretty darned hard to PROVE that they know it's rotted. The insurance company doesn't matter. USAA is a great company, they shouldn't give you any grief over it, however, you ARE going to have a deductible. Source(s): agent, 21+ years I'm going to say that unless your neighbor knew that their tree was either dead, dying or posed some risk to your property and did nothing about it, then they are not responsible for high winds damaging your house in this manner. Your insurance would be the one to cover this type of damage. that would fall on your policy to cover if it was caused by winds. your policy should cover the cost of removing the tree and cleanup and repairs to the home. agent in NC |
