Does anyone in SC know the STATE LAW for health insurance coverage when terminated? when does coverage end?? |
I was terminated from my job on April 5- they cancelled my insurance(which they pay for)the day before BUT I paid for my husbands insurance which was cancelled as well. Where do I go for answers-who do I call-what can I do? Its become very personal now-I want to get em! Help me. I know the federal law Combined OmniBus R Act (COBRA) look this up on google which they have to offer you insurance, it is super expensive because you have to pay ALL of the costs, so for a family of four it is like 1200 a month, but the thing is it is a continuation of your old policy, they have to send that to you soon after leaving. If they paid the 100% of the policy then they have the 'master' policy and you may be well right where you are now. They are supposed to give 30 days, but that is NC law. If you paid but it was a policy under the master they may only be liable to reimburse your premium for the month. I would be calling HR you paid for it the day before and should recieve that money back. Its called cobra Call the insurance company that your employer used and ask. The name and phone number should be on your policy or other forms. In my state(MS,) coverage remains in effect for 30 days or until the last day of the month in which you were terminated, unless you continue to pay it through Cobra, and then I think you can keep it for a full year. You would just have to start paying the premiums yourself.(which is probably very expensive) It may vary state to state. Modified 1 year ago |
