How do malpractice insurance premium rates vary among states? Obviously I cannot list every state, but there is variation based upon the state itself and the malpractice lawsuit climate within that state. States who have instituted punitive and financial caps on malpractice awards have seen a reduction in the premiums for coverage. I cannot recall these states offhand. "A report released by the American Medical Association in June 2002 identified the following 12 states as having med mal affordability/availability problems: Florida, Georgia, Mississippi, Nevada, New Jersey, New York, Ohio, Oregon, Pennsylvania, Texas, Washington and West Virginia.
