I don't know about Virginia laws, but usually insurance companies will opt for whatever is cheaper. If the cost to repair exceeds the value of the car, then they total it. If the cost to repair is less than the value of the car, then they repair it. It's simple math. No, $9,000.00 in damages is not a total loss for a $33,000.00 vehicle. If the cost of repairs exceeds about 75% - 80% of the value of the vehicle it will normally be written off. Less than that and it will be repaired.
