Where can I get free advice over a disagreement with my landlord over council tax? |
I should get council tax benefit but the bill is in his name and he won't change it! If the bill is in his name and he won't change it ,then I would let him pay it!!! It surely means that the liability is his, and any court proceedings would be in his name and not yours? End of problem. I find this strange, being a Landlord myself, as I cannot imagine why he would want to take on the responsibility of paying Council Tax when he doesn't have to - it's easy, all he has do to is phone Council Tax Dept and advise when you moved in and you will get the bill! Perhaps he thinks you wont settle the bill, but no matter what, the debt would be in your name if you didn't keep up the payments. if the bill is in his name then it is up to him to pay it. What some landlords do is keep the council tax in their name as if they are living there as it makes a difference when they decide to sell it, if they have been paying the council tax bill then they do not have to pay capital gains tax on their property, its a way out of paying tax and it sounds like he is doing this. If you are on benefits tell him that you can put the council tax in your name and then the benefil office will pay for it all. Check your tenancy agreement is may be you that has to inform the council that you are in occupancy. He will just inform them who was the tenant and it will be your liability not his.
