Law requiring us to file income tax? |
Is there really no law requiring us to pay income tax? If you say yes can you PLEASE post the law? dont just say "You idiot of course we have to pay it" Well, the 16th amendment CLARIFIED the power of Congress to lay and collect an income tax. Article 1, section 8 of the Constitution actually gave Congress the power to lay and collect an income tax. The actual law is the Internal Revenue Code and all of the subsequent changes to it. The IRC and the changes in effect have all been passed by Congress and signed by a President into law. The codification of that law is Title 26 of the U.S. Code. http://www2.law.cornell.edu/uscode/26/us... While Title 26 is the codification of the Internal Revenue Code, it is therefore, prima facie law. The "positive law" can be found in the U.S. Statutes at Large. The U.S. Statutes at Large are not available online to the best of my knowledge. However, they can be seen at any Federal Depository Library. While I won't call you an idiot, I will call the Browns idiots. 16th Amendment: http://caselaw.lp.findlaw.com/data/const... See United States Code Title 26, section 1. 16th Amendment merely gives Congress authority to establish and collect income taxes, but does not spell out what those taxes actually are. http://www.access.gpo.gov/uscode/title26... talk to a tax pro. but unless you have a income above a point you accualy don't have to file, but most of the time you are entiled to a refund in that case so it's worth it to file. The gov. hardly ever goes after low income people who don't file unless they feel they can get a decent amount. the link will tell you genaraly if you have to. http://www.hrblock.com/taxes/tax_tips/ta... |
