Has anyone ever transferred their student loans to with unsecured credit then declared bankruptcy? |
has anyone ever transferred their student loans to with unsecured credit then declared bankruptcy and got out of it. It sounds like it could be done like with a credit card or a line of credit or something so i was just wondering if anyone was ever successful at at it or if people think it could happen. If your saying you want to pay your loan off with a credit card and then declare bankruptcy and file against the credit card, I'm not sure with the new bankruptcy laws. Sounds like you scamming. I agree with the woman above me. When you file bankruptcy the judge goes line by line down your credit report (that they pull before you go in to see the judge). They will catch you scamming and you could get into a lot of trouble. A lawyer is unlikely to help you even file. Sorry but legally that won't work. If it did everyone who was in this situation would do the same thing. First, if you had good enough credit to pay a student loan off with an unsecured loan you probably don't need to declare bankruptcy in the first place. Second, to make sure you are not showing preference to certain creditors, you must declare any major payments made in the previous months. When you meet with the trustee they see this and ask how you paid off the Student Loan. When you tell them they will disallow it the bankruptcy. So, you will still owe it, but now likely at a higher interest rate than the rate of the Student Loan. If you lie about how you paid it, or don't declare the payments and they find out your entire bankruptcy could be thrown out. You could also find yourself in criminal court for fraud. My student loans are not eligible for bankruptcy, but your question intrigues me, as I am filing for bankruptcy this month....my credit is shot so I wouldn't be able to move them to unsecured credit anyway. In order to file now, you need to go through credit agencies which prove to the Federal government that you are really in hardship and not just trying to get out of bills. You'll have to try and convince them if you do it. Just pay your stupid student loans. Why should I have to pay for your education? File BK and say goodbye to the idea of any new student loans. Take a financial management class in this furthered education. |
